These Terms of Service ("Terms") govern your access to and use of PAWSCHECK, an AI-powered canine gait analysis platform operated by Concierge Vet LTD ("we," "us," or "our"). By accessing or using PAWSCHECK, you agree to be bound by these Terms.

1. Service Description

1.1 Platform Overview

PAWSCHECK is a Software-as-a-Service (SaaS) platform that uses artificial intelligence to analyse videos of dogs for gait abnormalities and potential lameness. Our service includes:

• Video upload and processing capabilities
• AI-powered gait analysis
• Automated lameness detection and lateralization identification
• PDF report generation with analysis results
• Historical tracking of analysis results

2.1 Subscription Tiers

2.2 Payment Terms

• Billing Cycle: Pay-as-you-go is a single one-off payment. Subscription plans bill monthly with a 2-month minimum sign-up.
• Payment Method: Valid credit/debit card or approved payment method required
• 2-Month Initial Commitment: All monthly subscriptions require a 2-month minimum sign-up. Your first invoice covers the first month plus a one-time commitment fee equal to one month, so you pay 2 months upfront. From day 60 the subscription continues to bill monthly and can be cancelled at any time
• Auto-Renewal: Monthly subscriptions will automatically renew unless cancelled (after the 2-month commitment period)
• Price Changes: We may change subscription prices with 30 days advance notice
• Taxes: Prices exclude applicable VAT and other taxes, which will be added at checkout
• Unused Allowance: Any unused analysis allowance included in subscription packages does not roll over to the next billing period and is forfeited at the end of each billing cycle. Purchased credit packs do not expire and will remain on your account until used.

2.3 Refund Policy

• 14-Day Money-Back Guarantee: Full refund on the Pay-as-you-go one-off payment if cancelled within 14 days and no analysis has been delivered
• 2-Month Initial Commitment: The first invoice (first month + commitment fee) is non-refundable except in cases handled at our discretion. Contact support if you have a concern
• Monthly Subscriptions (after commitment): Cancel any time from day 60 onward; no refunds for partial billing periods
• Unused Analyses: No refunds for unused monthly analysis credits or expired credit-pack credits
• Processing Time: Approved refunds processed within 10 business days

3. Acceptable Use Policy

3.1 Permitted Use

• Analysing your own dogs' gait patterns
• Monitoring pet health as part of veterinary care
• Professional veterinary practice (with appropriate licence)
• Research purposes (with our prior written consent)

3.2 Prohibited Activities

You may NOT:

• Upload videos of animals you do not own or have authorisation to analyse
• Use the service for any illegal, harmful, or fraudulent purposes
• Attempt to reverse engineer, decompile, or extract source code
• Circumvent usage limits, security measures, or anti-abuse mechanisms
• Share account credentials with unauthorised parties
• Create multiple accounts to abuse free trials or evade usage limits
• Use automated tools to scrape, crawl, or extract data from our platform
• Resell or sublicense access to PAWSCHECK without authorisation

4. Intellectual Property Rights

4.1 Our Intellectual Property

PAWSCHECK and all related technology, including software, algorithms, AI models, user interface design, and branding, are owned by Concierge Vet LTD or our licensors and are protected by copyright, trademark, and other intellectual property laws.

4.2 Your Content

You retain ownership of videos and data you upload. By uploading content, you grant us:

• A worldwide, non-exclusive licence to process, analyse, and store your content
• Permission to use anonymised data for AI model training and improvement
• Right to create derivative works (analysis reports) from your uploads

You may opt out of AI training usage through your account settings.

5. Disclaimers and Limitations

5.1 Service "As Is"

PAWSCHECK is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of accuracy, reliability, or completeness
• Promises of uninterrupted or error-free service

5.2 AI Technology Limitations

You acknowledge that:

• AI technology is inherently probabilistic and may produce errors
• Analysis accuracy depends on video quality and proper filming technique
• Results may vary based on lighting, angle, surface, and other factors
• The system is continuously improving but not perfect

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONCIERGE VET LTD SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Veterinary expenses or medical costs for your pet
• Damage resulting from incorrect analysis or missed diagnoses
• Harm to your pet from reliance on our service
• Service interruptions, data loss, or technical failures

Our total liability to you for all claims arising from your use of PAWSCHECK shall not exceed the greater of: the amount you paid us in the 12 months preceding the claim, or £100 (one hundred pounds sterling).

7. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. You agree that any legal action or proceeding shall be brought exclusively in the courts of England and Wales.
